Terms of Service

Whilst I will of course treat your tapes with the utmost care, as you are trusting me with irreplaceble and unique footage of your family, it's only fair to make the Terms of Service very clear before you make the decision to transfer your footage.

Limit of Liability

I only accept tapes on the understanding that I accept no liability for any loss of, or damage to, your tapes or DVDs.

I will not be liable for any economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, emotional distress, or any special, indirect or consequential damages (however arising, including negligence, technical failure, or inability to carry out transfers) arising out of, or in connection with, the use of this service.

Charging

As stated, I charge for every item given to me (i.e. each tape or DVD), unless found to be completely blank or (in the case of unmarked VHS tapes) containing nothing but unwanted TV programs. In the latter case I will check the first 10-15 minutes of each tape and then assume the rest of the tape only has similar unwanted footage, unless specifically told otherwise. 

Capture and Conversion Issues.

If you notice any issues with your files, please let me know within 14 days of receipt. I can then either reconvert the files from the AVI masters, or arrange to recapture the original footage, depending on the issue. This would be free of charge. 

After 14 days, if the issue is with an MP4 file (e.g. a corrupt file), I can send you a copy of the backup file. If this does not solve the issue and/or the issue is with the original capture however, I would need your tapes returned to recapture the footage; I reserve the right to charge for this at the original rate. 

Data Retention and File Back Up

Unless you specifically ask me to delete your files after delivery, I will keep a copy for a limited period of time, as follows:-

AVI Master Files: I keep two local backups of these files for 14 days after delivery.

MP4 Conversions: I keep two local backups of these files for 30 days after delivery, and one copy for a further 30 days.

Cloud Storage: Any files uploaded to my OneDrive account for you to view/download/share will be available for 30 days after upload. 

I occasionally retain copies of either file type for a longer period of time, purely as an unofficial additional off-site backup for clients; this is free of charge. However, this is not guaranteed and is completely dependent on the amount of storage I have available. Please back up your files as soon as possible! 

If there is a specific reason you'd like me to keep a copy of any of your file(s) for a longer period, please let me know and I'll see what I can do.
